JJ Clix Terms Of Service

Why do we have these T.O.S?
Rules schmooles right? Well, unfortunately to maintain a smooth running site these need to be put in place and adhered to at all times, these T.O.S are here to help protect all concerned, that includes the owner of the site, the members of the site and the advertisers of the site. It helps insure that the honest members get paid, and the advertisers get the most out of their advertising dollar. Please read these before joining so you are well aware of what is required of you to stay active and other important information that is relevant to all of us at some time or another.

By signing up and actively using the JJ Clix program you agree to all terms and conditions set forth in this agreement. JJ Clix may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its affiliates. Affiliates will be informed of any and all changes to this policy via an e-mail to their primary contact e-mail address provided upon signing up with JJ Clix. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the JJ Clix program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Affiliates:
You MUST BE ABLE TO READ ENGLISH! If you check the wrong boxes in the categories of interest you will be deleted as this shows that you either can’t read English or you blind click. You must be 18 years or older to become an affiliate with JJ Clix. JJ Clix is open to all International members EXCLUDING & not limited to: China, India, Poland, Russia, Vietnam, Hong Kong, Iran & Iraq, Asia Pacific Region, Mayotte, Reunion, Taiwan, Thailand & any member using "Other" as their Country of residence. These excluded countries may be added to at any given time with out prior notice by the site. You are also excluded from this site if you are prohibited by your local state and/or country laws.

You agree to and must use your own name and e-mail address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different e-mail addresses. Your computer must not be shared with another individual that has an existing JJ Clix account. You may also NOT give false address information regarding your country of origin. ALL IP addresses are checked and anyone who has falsely given information will be terminated immediately.

You will use your e-mail address / password combination to access your account, it is your responsibility to keep this information confidential. You may change this information by logging into your account and following the "User Account Info." link. You are solely responsible for any and all use of your JJ Clix account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by JJ Clix be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you used when signing up with JJ Clix. You agree to receive e-mail advertising from JJ Clix limited to no more than (250) per day. In some cases this amount may be exceeded, this all depends on member volume and the amount of ads that are placed.

In the event your e-mail account on file becomes closed or blocked to messages from JJ Clix, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

If you change your account to vacation/holiday mode due to you being away or unable to participate for any length of time, you will be exempt from the minimum requirements ONLY for the period of time that you specify when notifying the site of this change. You will NOT earn from your referrals while you are on vacation/holiday mode.

Relationship of the Parties:
You and JJ Clix are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and JJ Clix. You understand that you do not have authority to make or accept any offers or make any representations on behalf of JJ Clix. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
JJ Clix will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or JJ Clix program, even if JJ Clix has been advised of the possibility of such damages. Furthermore, JJ Clix aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by JJ Clix. Affiliates may earn by referring new affiliates to the JJ Clix program. Affiliates will earn 15 % of advertising revenues collected by JJ Clix. Affiliates are only paid once their accounts are deemed as being active.

Active Accounts & Inactivity:
Being active consists of logging in at least once in a 14 day period & clicking a minimum of 50 emails a month. If you break this down it only means you need to click at least 13 emails per week to stay active. This DOES NOT include site clicks ie: Contest PTC, PTP Ptc etc. Any member who does not log in within 30 days will have their account suspended.

JJ Clix will pay affiliates when their balance reaches the minimum payout rate set by JJ Clix which can be found on the upgraded members page if you are an upgraded member, if you are not upgraded, then the minimum cash out is $3.00. Once the member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after.

Payments will be paid via Paypal & E-gold. E-gold has a 5% fee attached - Paypal has no fee.

Payments will NOT be made to any member unless they have read and agreed to our Terms of Service, this is done by checking the "I have read the T.O.S" box in your interest categories. Any member who requests payout with out having this checked will have their payment denied. Requesting 3 or more times without having done this will result in your account being suspended until it is checked & you have read these terms. ( Added on 19th of June 2007.)

PLEASE NOTE: When requesting e-gold, you WILL wait for your payout. E-gold is difficult to fund and takes time for transfers to be made. If you request e-gold, you may wait the FULL 30 days for your payout. Please DO NOT email me asking where your payout is! If you do, I will cancel your request and you will then have to request again and wait in line all over again.

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with JJ Clix and may result in legal prosecution. JJ Clix strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. JJ Clix may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts, this includes and is not limited to sign ups from the same address & sign ups using the same paypal or e-gold accounts. Signing up multiple times from the same computer also constitutes fraud. JJ Clix will file charges for recovery of any earnings received from multiple sign-ups.

Cheating:
If you are caught cheating in anyway, you will be DELETED & you also lose all prior earnings from yourself and your referrals. If you check the “Donate all I make” “I cheat, lots, all the time” “I don’t speak English” “Randomly Delete me” or “who checks these anyway” when selecting your categories of interest, your account will be DELETED & any earnings you may have will be lost. Same rule applies for the the boxes that appear with our admin messages, if you click a cheat/English test box, you will be deleted.
We will be sending out random cheat links in emails. If you click more than 3 of these, you will be DELETED and all prior earnings lost. If your account was deleted due to cheating, you will NOT be permitted to re-join this site. If you do re-join, we will find your account and delete it as well.
Bottom line, I WILL NOT TOLERATE cheating of ANY kind! JJ Clix members, owners & advertisers work FAR too hard to have to deal with cheaters! If your account is suddenly missing, you now know why!

Additional Terms Added 19th of June 2007.

Paid To Sign Up (PTSU)
All members who earn via our Paid to sign up page must do so honestly.
You can not create your own confirmation email to use as proof of joining.
You can not join the same program more than ONE time.
All Sign ups are checked prior to payment & any one caught cheating/abusing this service will have their accounts deleted immediately.

No Tolerance to Abuse
Any member who abuses us either in our Forum or via E-Mail will have their account deleted and IP address blocked. We will not tolerate being abused whether it be threats to us or towards our site.
This same rule goes for on our Forum and against other members.
We have ZERO Tolerance for this kind of behaviour and any one caught doing this will be deleted.

Inactivity
If your account becomes inactive (please see terms above for how to remain active) your account WILL be suspended. Once this has happened to your account, you then have 7 days to contact us requesting it be reinstated. If you do not do this, it will not be reactivated and there will be no exceptions. All accounts are purged once they have not been inactive for 38 days.

Additional Terms Added 28th of June 2007.
Any Webmaster/Program Owner who is a member of JJ Clix & ban's JJ Clix for allowing multiple link clicking will NOT be permitted to multi click at this site. Doing so is a conflict of interest on your behalf and hypocritical.
Any PO caught doing this will have their account suspended and will not be reinstated until JJ Clix is taken off of their banned list.
